Direct Answer: Why must a court judgment be formally served in Tunisia?

Under Tunisian law, a judgment rendered by a court cannot be enforced, nor do appeal periods (appeal, opposition or cassation) start running against the losing party, without formal service of the judgment by a licensed judicial bailiff (huissier de justice). Official service removes any dispute over whether the losing party knew of the decision. In standard civil proceedings, the appeal period is 20 days starting the day after service (Code of Civil and Commercial Procedure, Art. 140 et seq.); if no appeal is filed within that window, the judgment becomes final and acquires the force of res judicata. Service is also an essential prerequisite to forced execution: no seizure or eviction may begin before the enforceable title bearing the executory formula has been served. Acting under Organic Law No. 2018-9 (Art. 13), the bailiff obtains the certified copy from the court registry, serves it at the losing party's address and hands the requesting party the certificate proving service.
