What does a judicial bailiff (huissier de justice) do in Tunisia?
A judicial bailiff (huissier de justice, عدل منفذ) is a public officer governed by Organic Law No. 2018-9 of 30 January 2018. Article 13 of that law sets out the bailiff's duties: serving judicial and extrajudicial documents (summonses, judgments, formal demands, lease terminations), enforcing judgments and other enforceable titles (seizures, evictions), drawing up physical or digital inspection reports (constats) that are conclusive until successfully challenged for forgery (inscription de faux), recovering debts amicably, conducting public auctions and holding conciliation attempts. Fees are not freely set: they follow the schedule of the joint order (arrêté) of the Ministers of Justice and Finance of 25 June 2021 (JORT No. 55 of 29 June 2021).
